Supreme Court Upholds Gov. Fayose's Election

The Supreme Court this morning Tuesday April 14th, upheld the election of Mr. Ayodele Fayose as the Ekiti State Governor.

‎In a unanimous decision by the seven-man panel led by Justice John Fabiyi, the Supreme Court dismissed all the grounds in the Eligibility case brought before the court by APC members in the Ekiti State House ofAssembly.

The apex court ruled that impeachment was not a tenable ground for disqualification of a candidate from contesting as governor, and said Fayose impeachment on October 16, 2006, was illegally and unconstitutionally constituted.

The panel also struck out allegations of certificate forgery against Fayose. It was determined that the HND certificate presented by Fayose to run for Governorship election was genuinely earned and awarded to him. Also, the allegations that Fayose employed the use of the military to intimidate APC supporters during the June 2014 governorship election, the Supreme Court ruled that the Chief of Defence Staff and the Inspector-General of Police, joined as 4th and 5th defendants in the case were not necessary parties.

Earlier, the APC members had dragged Fayose before the Appeal Court and the Ekiti State Governorship Election Tribunal, where his election was upheld, on the grounds that the petition lacked merit. But the legislators took the case further to the apex Court, which also ruled in Fayose's favour today. They had argued that Fayose was not eligible to contest on the grounds that he was impeached during his first administration.
